Draft Minutes of a Special Parish Council meeting on 19th December, 2006,

at 7.00pm at the Clubhouse

1                  Declarations of interest.

(i)                  Cllr Wheatstone declared a prejudicial interest in application numbers 6947, 6915 & 6925 (Noah’s Ark).

(ii)                Cllr Marshall declared a personal interest – application number 6947.

(iii)              Cllr Cullen declared a personal interest in application numbers 6915, 6925 & 6947.

(iv)               Cllr Gover declared a personal interest in application numbers 6915, 6925 & 6947.

2                  To receive and accept apologies for absence.

(i)                  Apologies accepted from Cllr Binns (vice chair), Cllr Wheeler & Cllr Fairbank.

3                  To approve minutes of the meetings held on Dec 14th.

(i)                  Minutes approved with the following amendments:

i)                    Declarations of interest by both Cllrs Wheatstone and Marshall to show a prejudicial interest.

ii)                  Correction of spelling from past to passed in item 8.

4                  Matters arising from the minutes.

(i)                  Cllr Cullen reported that street lights 1 & 2 are not functioning. Clerk to contact Highways to get them repaired.

5                  Questions from the floor.

(i)                  No questions.

 

6                  Planning applications received:

(i)                  Cllr Wheatstone left the meeting because of prejudicial interest.

·        Application No. 53/2006/6915. Variation of condition no.11 of Planning Consent No. 53/2006/6434 to allow use of white upvc windows instead of timber windows in barn conversion at Noah’s ark Boarding Kennels, Outlaithe Farm, Lothersdale. Applicant J Elvy.

o        J Elvy explained that the change to upvc windows was necessary due to the adverse weathering which takes place to wooden windows in that exposed location. And white would be in keeping with the minimal style she desired.

§         The council had no objections.

·        Application No. 53/2006/6925. For a new window opening in NW elevation of Barn conversion at Noah’s ark Boarding Kennels, Outlaithe Farm, Lothersdale. Applicant J Elvy.

o        The council had no objections.

·        Application No. 53/2006/6947.  For a split level extension to the NW elevation and porch to SW elevation at Horrocks Close, Lothersdale, BD20 8HQ. Applicant Mr & Mrs S Shaw.

o        The council had no objections providing that all materials matched existing materials.

7                  To consider the budget for 2006/07. Cllr Wheatstone proposed that Clerk to provide actuals for January’s meeting. Proposal seconded by Cllr Cullen.

8                  To consider taking action to ensure contracts are respected.

(i)                  Cllr Wheatstone moved that public and pres remove themselves from the meeting for this item. Cllr Gover seconded and Cllr Cullen abstained. The public left the meeting for this item.

(ii)                Cllr Wheatstone proposed and Cllr Cullen seconded that the council instruct their solicitor to write to Mr Cohen informing him that the agreement has been breached and that further action may ensue if the agreement is breached again.

(iii)              The press and public were invited back into the meeting.

9                  To consider disabled parking space outside Rose In The Dale.

(i)                  Cllr Gover reported that The Spencer Homes trust is not in support of the idea because:

i)                    There is no obvious space for it to go.

ii)                  It is not an issue on a very frequent basis.

iii)                During the day there is often space available.

(ii)                Cllr Gover recommended that the council follows the trusts advice.

(iii)              Cllr Wheatstone suggested that the trust might want to consider a wall mounted sign.

(iv)               Cllr Gover to report back to the trust and report back to the council in March 07.

10               Items of minor information.

(i)                  Paper recycling bin is overflowing.

(ii)                Condition of the road out towards the cross roads to be discussed at January’s meeting.
